Kullanım Koşulları

Bu kullanım koşulları, Fabervant Teknoloji A.Ş. ("biz", "bizim") tarafından geliştirilen DuPari uygulaması ve web sitesinin (dupari.com) kullanımına ilişkin şart ve koşulları belirler. Hizmeti kullanarak bu koşulları kabul etmiş sayılırsınız.
1. Hizmet Tanımı
DuPari, cilt bakım ürünlerinde fiyat karşılaştırma ve dupe (uygun fiyatlı alternatif) bulma hizmeti sunan bir uygulama ve web platformudur. Hizmetlerimiz şunları içerir:
- Farklı satıcılar arasında ürün fiyat karşılaştırması
- Ürünlere uygun fiyatlı alternatif (dupe) önerileri
- Ürün arama ve filtreleme
- Favori listeleri oluşturma
- Satıcı web sitelerine yönlendirme bağlantıları
2. Affiliate Bağlantıları ve Komisyon Açıklaması
Önemli bilgilendirme: DuPari, satıcı web sitelerine yönlendirme (affiliate) bağlantıları içerir. Bu bağlantılara tıkladığınızda ve/veya alışveriş yaptığınızda, DuPari komisyon geliri elde edebilir. Bu durum, gösterilen fiyatları veya ürün sıralamasını etkilemez. Fiyatlar doğrudan satıcı web sitelerinden alınır.
Affiliate programları kapsamında çalıştığımız platformlar arasında Trendyol, Hepsiburada ve Amazon.com.tr gibi e-ticaret siteleri bulunmaktadır. Affiliate bağlantıları uygulama ve web sitesinde belirtilir.
3. Hesap Oluşturma ve Güvenlik
DuPari'nin temel özellikleri hesap oluşturmadan kullanılabilir. Hesap oluşturmayı tercih ederseniz:
- Sağladığınız bilgilerin doğru ve güncel olmasından siz sorumlusunuz
- Hesap güvenliğinizi korumak sizin sorumluluğunuzdadır
- Hesabınız aracılığıyla gerçekleştirilen tüm işlemlerden siz sorumlusunuz
- Yetkisiz erişim sezdiğinizde derhal bize bildirmelisiniz
4. Kullanıcı İçerikleri ve Katkılar
DuPari'ye içerik katkı sağladığınızda (ürün bilgisi düzeltme, yeni ürün ekleme vb.):
- Sağladığınız içeriğin doğru ve yanıltıcı olmadığını taahhüt edersiniz
- Üçüncü tarafların fikri mülkiyet haklarını ihlal etmediğinizi garanti edersiniz
- DuPari'ye bu içeriği hizmet kapsamında kullanma, düzenleme ve gösterme hakkı verirsiniz
- DuPari, uygunsuz veya yanıltıcı içeriği kaldırma hakkını saklı tutar
Yasak Kullanımlar
Aşağıdaki davranışlar kesinlikle yasaktır:
- Hizmeti yasadışı amaçlarla kullanmak
- Yanıltıcı veya sahte ürün bilgisi girmek
- Otomatik veri kazıma (scraping) araçları kullanmak
- Hizmetin işleyişini bozmaya çalışmak
- Diğer kullanıcıların hesaplarına yetkisiz erişim
- Kötü niyetli yazılım (malware) dağıtmak
5. Fiyat Bilgileri ve Sorumluluk Sınırlaması
Önemli uyarı: DuPari, satıcı web sitelerinden alınan fiyat bilgilerini gösterir. Fiyatlar gerçek zamanlı olarak değişebilir ve gösterilen fiyatlar ile satın alma anındaki fiyatlar arasında farklılıklar oluşabilir. DuPari, fiyat bilgilerinin doğruluğunun garantisini vermez.
- Ürün bilgileri (içerik, fiyat, stok durumu) satıcı web sitelerinden sağlanır ve DuPari bunların doğruluğunun garantisini vermez
- Dupe (alternatif) önerileri, içerikteki benzerliklere dayanır; bireysel cilt reaksiyonları veya sonuçları için sorumluluk kabul edilmez
- DuPari bir satın alma platformu değildir; yönlendirdiği satıcı sitelerdeki işlemlerden sorumlu değildir
- Hizmetin kesintisiz ve hatasız çalışacağının garantisi verilmez
6. Fikri Mülkiyet
DuPari uygulaması, web sitesi, logosu, tasarımı, kaynak kodu ve ilgili tüm materyaller Fabervant Teknoloji A.Ş.'nin mülkiyetindedir ve telif hakları ile korunmaktadır.
- DuPari'nin ismini, logosunu veya ticari markalarını izinsiz kullanamazsınız
- Uygulamanın kaynak kodunu tersine mühendislik yapamaz, kopyalayamaz veya dağıtamazsınız
- Hizmetin herhangi bir bölümünü izinsiz çoğaltamaz veya ticari amaçla kullanamazsınız
Üçüncü taraflara ait ürün isimleri, logoları ve markaları ilgili sahiplerinin mülkiyetindedir.
7. Hesap Askıya Alma ve Sonlandırma
DuPari, aşağıdaki durumlarda hesabınızı askıya alma veya kalıcı olarak sonlandırma hakkını saklı tutar:
- Bu kullanım koşullarının ihlali
- Yanıltıcı veya sahte bilgi sağlanması
- Hizmetin kötüye kullanılması
- Yasal gereklilikler
Hesap sonlandırma halinde, kişisel verileriniz Gizlilik Politikamız uyarınca işlenir.
8. Sorumluluk Sınırlaması
Yürürlükteki yasaların izin verdiği azami ölçüde:
- DuPari, hizmetin kullanımından veya kullanılamama durumundan kaynaklanan doğrudan, dolaylı, arızi, özel veya cezai tazminat taleplerinden sorumlu değildir
- Üçüncü taraf web sitelerine yapılan yönlendirmelerden kaynaklanan zarar veya kayıplardan sorumluluk kabul edilmez
- Hizmetin herhangi bir nedenle kesintiye uğraması veya sona ermesi durumunda sorumluluk kabul edilmez
9. Değişiklikler
Bu kullanım koşullarını zaman zaman güncelleme hakkımız saklıdır. Önemli değişiklikler yapıldığında uygulama içi bildirim ve/veya e-posta yoluyla bilgilendirilirsiniz. Güncellenmiş koşullar, bu sayfada yayınlandığı tarihte yürürlüğe girer. Değişikliklerden sonra hizmeti kullanmaya devam etmeniz, güncel koşulları kabul ettiğiniz anlamına gelir.
10. Uygulanacak Hukuk ve Uyuşmazlık Çözümü
Bu kullanım koşulları Türkiye Cumhuriyeti yasalarına tabidir. Bu koşullardan doğan veya bunlarla ilişkili herhangi bir uyuşmazlık, Türkiye Cumhuriyeti mahkemelerinin yargı yetkisine tabidir.
Tüketici hakları konusunda başvurularınızı Tüketici Hakem Heyetleri'ne veya Tüketici Mahkemeleri'ne yapabilirsiniz.
11. Bütünlük ve Ayrılabilirlik
Bu koşulların herhangi bir hükmünün geçersiz veya uygulanamaz olması halinde, diğer hükümler tam olarak yürürlükte kalır. Geçersiz hüküm, amacına en yakın geçerli bir hükümle değiştirilmiş sayılır.

These terms of service set out the terms and conditions for use of the DuPari application and website (dupari.com), developed by Fabervant Teknoloji A.Ş. ("we", "our", "us"). By using the service, you agree to these terms.
1. Service Description
DuPari is an application and web platform that provides skincare product price comparison and dupe (affordable alternative) finding services. Our services include:
- Product price comparison across different retailers
- Affordable alternative (dupe) recommendations for products
- Product search and filtering
- Creating favorites lists
- Referral links to retailer websites
2. Affiliate Links and Commission Disclosure
Important disclosure: DuPari contains affiliate (referral) links to retailer websites. When you click on these links and/or make a purchase, DuPari may earn commission revenue. This does not affect the prices shown or product ranking. Prices are sourced directly from retailer websites.
Platforms we work with under affiliate programs include e-commerce sites such as Trendyol, Hepsiburada, and Amazon.com.tr. Affiliate links are indicated in the application and website.
3. Account Creation and Security
DuPari's core features can be used without creating an account. If you choose to create an account:
- You are responsible for ensuring the information you provide is accurate and up to date
- Maintaining the security of your account is your responsibility
- You are responsible for all activities carried out through your account
- You must notify us immediately if you suspect unauthorized access
4. User Content and Contributions
When you contribute content to DuPari (product information corrections, adding new products, etc.):
- You warrant that the content you provide is accurate and not misleading
- You guarantee that you are not infringing third-party intellectual property rights
- You grant DuPari the right to use, edit, and display this content as part of the service
- DuPari reserves the right to remove inappropriate or misleading content
Prohibited Uses
The following behaviors are strictly prohibited:
- Using the service for illegal purposes
- Entering misleading or false product information
- Using automated data scraping tools
- Attempting to disrupt the operation of the service
- Unauthorized access to other users' accounts
- Distributing malicious software (malware)
5. Price Information and Limitation of Liability
Important notice: DuPari displays price information sourced from retailer websites. Prices may change in real time, and differences may occur between displayed prices and prices at the time of purchase. DuPari does not guarantee the accuracy of price information.
- Product information (ingredients, prices, stock availability) is sourced from retailer websites, and DuPari does not guarantee their accuracy
- Dupe (alternative) recommendations are based on ingredient similarities; no responsibility is accepted for individual skin reactions or results
- DuPari is not a purchasing platform; it is not responsible for transactions on the retailer sites it redirects to
- No guarantee is given that the service will operate without interruption or error
6. Intellectual Property
The DuPari application, website, logo, design, source code, and all related materials are the property of Fabervant Teknoloji A.Ş. and are protected by copyright.
- You may not use DuPari's name, logo, or trademarks without permission
- You may not reverse engineer, copy, or distribute the application's source code
- You may not reproduce or use any part of the service for commercial purposes without permission
Product names, logos, and brands belonging to third parties are the property of their respective owners.
7. Account Suspension and Termination
DuPari reserves the right to suspend or permanently terminate your account in the following situations:
- Violation of these terms of service
- Providing misleading or false information
- Misuse of the service
- Legal requirements
In the event of account termination, your personal data will be processed in accordance with our Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- DuPari is not liable for direct, indirect, incidental, special, or punitive damages arising from the use or inability to use the service
- No liability is accepted for damages or losses arising from redirections to third-party websites
- No liability is accepted if the service is interrupted or discontinued for any reason
9. Changes
We reserve the right to update these terms of service from time to time. When significant changes are made, you will be notified via in-app notification and/or email. Updated terms take effect on the date they are published on this page. Continuing to use the service after changes constitutes acceptance of the current terms.
10. Governing Law and Dispute Resolution
These terms of service are governed by the laws of the Republic of Turkey. Any disputes arising from or related to these terms are subject to the jurisdiction of the courts of the Republic of Turkey.
For consumer rights matters, you may apply to Consumer Arbitration Committees or Consumer Courts.
11. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be deemed replaced by the closest valid provision that achieves its purpose.
